WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated February 10, 2010, executed by CHARLES R. SMITH and DANALYNN D. SMITH conveying certain real property therein described to ALLAN B. POLUNSKY, as Trustee, for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, AS NOMINEE FOR PRIMELENDING, A PLAINSCAPITAL COMPANY, Original Beneficiary, to secure the indebtedness therein described, as same appears of record in the office of the Chancery Clerk of Tishomingo County, Mississippi filed and recorded February 11, 2020, at Instrument Number 202000548; and
WHEREAS, the beneficial interest of said Deed of Trust was transferred and assigned to Wilmington Savings Fund Society, FSB, as trustee of Stanwich Mortgage Loan Trust M; and
WHEREAS, Rubin Lublin, LLC has been appointed as Substitute Trustee; and
NOW, THEREFORE, the holder of said Deed of Trust, having requested the undersigned so to do, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee shall, on May 17, 2023 within the lawful hours of sale between 11:00AM and 4:00PM at the front steps of the Courthouse proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Tishomingo County, Mississippi, to wit:

SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE
WHEREAS, on July 30, 2020, James M. Brown and wife, Sherry L. Brown, as tenants by the entirety with full rights of survivorship and not as tenants in common executed a certain deed of trust to Westcor Land Title Insurance Company, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as Beneficiary, as nominee for Freedom Mortgage Corporation, its successors and assigns which deed of trust is of record in the office of the Chancery Clerk of Tishomingo, County, state of Mississippi, on August 14, 2020, as Document Number 2020002822.

SECTION 307.03-05 “AS A SPECIAL EXCEPTION ONLY, IN THE A-I AGRICULTURAL DISTRICT” TO THE COMPREHENSIVE LAND USE REGULATION AND ZONING ORDINANCE
BE IT ORDAINED that Section 307.03-05 be added to the Comprehensive Land Use Regulation and Zoning Ordinance adopted August 6, 2013, as follows:
307.03-05 Facilities in support of tourism and agri-tourism including tourist homes which may be non-traditional in size, material or design, and with such density, set-backs and restrictions as the Board of Aldermen may approve.
To be effective one month from passage.
A hearing on said amendment is hereby set for the 6th day of June, 2023, at 5:45 p.m. before the Board of Aldermen and the City Clerk is hereby directed to provide notice thereof in accordance with applicable law and Section 500.01-02 of the Comprehensive Land Use Regulation and Zoning Ordinance adopted August 6, 2013.
