WHEREAS, on the 20th day of July, 2016, Joe Mathis, a married man, and Tamara Mathis for the sole purpose of waiving marital rights, executed and delivered a certain Deed of Trust unto Kathryn L Harris, Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for Community Mortgage Corporation, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Tishomingo County, Mississippi in Instrument# 2016002142; and
WHEREAS, on the 20th day of August, 2020, Mortgage Electronic Registration Systems, Inc. as beneficiary, as nominee for Community Mortgage Corporation, assigned said Deed of Trust unto PennyMac Loan Services, LLC, by instrument recorded in the office of the aforesaid Chancery Clerk in Instrument# 2020003318; and; and
WHEREAS, on the 1st day of April, 2022 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Instrument# 2022001299; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 27th day of October, 2022, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the east front door Tishomingo County Courthouse, 1008 Battleground Drive at Iuka, Mississippi, for cash to the highest bidder, the following described land and property situated in Tishomingo County, Mississippi, to-wit:

A Part of the Southeast Quarter of Section 28, Township 3 South, Range 11 East, Chickasaw Meridian, Tishomingo County, Mississippi, being more particularly described as follows: Commencing at an axle found by a fence corner at the Southeast Corner of the Southeast Quarter; thence with the State Plane Grid run with the East Line of the said Southeast Quarter North 00 degrees 10’20” East for a distance of 428.35 feet to the Point of Beginning, being South 00 degrees 10’20” West at a distance of 10.16 feet from a railroad spike found in a gravel drive, Thence leaving the said East line, run South 86 degrees 10’01” West for a distance of 91.99 feet to a railroad spike set in the Easterly Right-of-Way of County Road #255, also known as Oldham Road, having an indicated Right-of-Way of 30 feet; Thence run with the said Right-of-Way North 23 degrees 13’33” West for a distance of 172.21 feet; Thence run along a curve concave to the left having a radius of 503.16, and a chord bearing of North 31 degrees 31’04” west, (chord length 145.13 feet) through a capped iron pin set 127.04 feet, designated Point “B”, for an total arc distance of 145.65 feet to a capped iron pin set; Thence leaving the said Right-of-way, run North 54 degrees 36’39” East for a distance of 162.74 feet to a capped iron pin set; Thence run South 23 degrees 59’56” East for a distance of 56.83 feet to a capped iron pin set; Thence run North 82 degrees 53’57” East for a distance of 73.25 feet to a capped iron pin set in a wire fence; Thence run South 03 degrees 29’35” East through a capped iron pin set at 34.57 feet, designated Point “A”, for a total distance of 126.40 feet to a capped iron pin set in the aforesaid East Line of the said Southeast Quarter; Thence run with the said East Line South 00 degrees 10’20” West a distance of 201.05 feet to the Point of Beginning, containing 1.26 Acres, more or less subject to an Easement for Ingress and Egress, retained by the grantor, being 16 feet wide, and being more particularly described as follows: Beginning at a capped iron pin set at aforesaid designated Point “A” in the Easterly Line of the subject parcel; Thence run South 81 degrees 50’39” West for a distance of 221.18 feet to a capped iron pin set in the aforesaid Easterly Right-of-Way of County Road #255, at designated Point “B”; Thence run with the said Right-of-Way chord bearing of North 38 degrees 45’05” West for a chord distance of 18.59 feet to a capped iron pin set; Thence leaving the Right-of-Way, run North 81 degrees 50’39” East for a distance of 231.94 feet to the said Easterly Line of the subject parcel; Thence run with the said Easterly Line South 03 degrees 29’35” East for a distance of 16.05 feet to the Point of Beginning.
